Welcome to Weathlyzer! These Terms of Service ("Terms") govern your access to and use of the Weathlyzer website, applications, and services (collectively, the "Service"). Please read these Terms carefully before using our Service. By accessing or using the Service, you signify your agreement to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Weathlyzer. Your continued use of the Service after any modifications to these Terms indicates your acceptance of the revised Terms. We reserve the right to update or modify these Terms at any time without prior notice, and it is your responsibility to review them periodically.

1. Acceptance of Terms

By creating an account, accessing, or using the Weathlyzer Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy and Cookie Policy, which are incorporated herein by reference. These Terms apply to all visitors, users, and others who access or use the Service. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and representing that you have the authority to bind that organization to these Terms. In that case, "you" and "your" will refer to that organization. If you do not agree with any part of these Terms, you must immediately cease all use of the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes. 2. Description of Service

Weathlyzer provides a comprehensive weather forecasting service that includes, but is not limited to, current weather conditions, hourly forecasts, 7-day extended forecasts, detailed meteorological parameters (such as wind speed, humidity, UV index, visibility, pressure, sunrise/sunset times, and Air Quality Index), interactive weather radar maps, graphical charts for historical and forecasted data, severe weather alerts and notifications, seasonal weather-based recommendations, festival and travel weather planning tools, and additional content like news articles, climate updates, and user-generated weather media. Our Service aims to deliver accurate, timely, and user-friendly weather information to help you plan your activities and stay informed about atmospheric conditions. While we strive for the highest level of accuracy, all weather data and forecasts are provided for informational purposes only and are subject to the inherent variability and unpredictability of meteorological science. The Service may evolve over time, and we reserve the right to modify, suspend, or discontinue any aspect of the Service at our sole discretion, without prior notice. We will endeavor to provide notice of significant changes where feasible.

3. User Accounts and Registration

While much of Weathlyzer's content is accessible without registration, certain features, such as personalized alerts, saving preferred locations, or contributing user-generated content, may require you to create an account. When you register for an account, you agree to:

• Provide accurate, current, and complete information as prompted by the registration form.
• Maintain and promptly update your account information to keep it accurate, current, and complete.
• Maintain the security of your password and identification.
• Accept all risks of unauthorized access to your account and the information you provide to us.
• Notify us immediately of any unauthorized use of your account or any other breach of security.

You are solely responsible for all activities that occur under your account, whether or not you know about them. Weathlyzer cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations. We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof) if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect that such information is inaccurate, not current, or incomplete. Accounts are non-transferable.

4. Intellectual Property Rights

All content, features, and functionality on the Weathlyzer Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof (collectively, "Content"), are the exclusive property of Weathlyzer, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The Weathlyzer name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Weathlyzer or its affiliates or licensors. You must not use such marks without the prior written permission of Weathlyzer.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its Content for your personal, non-commercial use only, subject to these Terms. This license does not include any rights to:

• Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content, except as generally permitted by the Service's normal functionality.
• Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
• Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this site.
• Access or use for any commercial purposes any part of the Service or any services or materials available through the Service.

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Service in breach of the Terms, your right to use the Service will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. No right, title, or interest in or to the Service or any Content on the Service is transferred to you, and all rights not expressly granted are reserved by Weathlyzer. Any use of the Service not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.

5. User-Generated Content

The Service may allow you to submit, upload, publish, or otherwise make available content, including but not limited to text, photographs, videos, and comments ("User Content"). You retain all rights in, and are solely responsible for, the User Content you make available through the Service.

By making any User Content available through the Service, you hereby grant to Weathlyzer a worldwide, non-exclusive, transferable, sublicensable, royalty-free, perpetual, irrevocable license to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform, and otherwise exploit your User Content in connection with the Service and Weathlyzer's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.

You represent and warrant that:

• You are the sole and exclusive owner of all User Content that you make available through the Service or you have all rights, licenses, consents, and releases that are necessary to grant to Weathlyzer the rights in such User Content, as contemplated under these Terms.
• Neither the User Content nor your posting, uploading, publication, submission, or transmittal of the User Content or Weathlyzer's use of the User Content (or any portion thereof) will infringe, misappropriate, or violate a third party's patent, copyright, trademark, trade secret, moral rights, or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

You agree not to provide User Content that:

• Is defamatory, libelous, hateful, violent, obscene, pornographic, unlawful, or otherwise offensive, as determined by Weathlyzer in its sole discretion.
• Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.
• Is false, inaccurate, or misleading.
• Violates any third-party rights, including copyright, trademark, privacy, or publicity rights.
• Contains viruses or other harmful computer code, files, or programs.
• Impersonates any person or entity or misrepresents your affiliation with a person or entity.

Weathlyzer reserves the right, but is not obligated, to remove or disable access to any User Content at any time and without notice, including, but not limited to, if Weathlyzer, at its sole discretion, considers any User Content to be objectionable or in violation of these Terms.

6. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms of Service. You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate Weathlyzer, a Weathlyzer employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Weathlyzer or users of the Service, or expose them to liability.

Additionally, you agree not to:

• Use the Service in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Service, including their ability to engage in real-time activities through the Service.
• Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
• Use any manual process to monitor or copy any of the material on the Service, or for any other unauthorized purpose without our prior written consent.
• Use any device, software, or routine that interferes with the proper working of the Service.
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.

Weathlyzer has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Weathlyzer shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit. Your interactions with organizations and individuals found on or through the Service, including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such organizations or individuals. You agree that Weathlyzer shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.

8. Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WEATHLYZER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WEATHLYZER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS MAKE NO WARRANTY THAT:

• THE SERVICE WILL MEET YOUR REQUIREMENTS;
• THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
• THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE;
• THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; AND
• ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM WEATHLYZER OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.

Specifically, regarding weather data, while Weathlyzer utilizes advanced meteorological models and data sources, weather forecasting is an inherently uncertain science. Forecasts are based on complex atmospheric conditions and are subject to change rapidly. Weathlyzer does not guarantee the accuracy, completeness, or reliability of any weather information provided, and you acknowledge that such information is for informational purposes only and should not be relied upon for critical decisions, particularly those related to safety or property. Always consult official government meteorological agencies for critical weather warnings and advisories.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEATHLYZER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF WEATHLYZER AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, AND SUPPLIERS FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID TO WEATHLYZER, IF ANY, IN THE PAST TWELVE MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, WEATHLYZER'S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless Weathlyzer, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms of Service or your use of the Service, including, but not limited to, your User Content.
• Your use of any information obtained from the Service.
• Your violation of any rights of another party, including intellectual property rights.
• Any third-party claim arising from your use of the Service.

This indemnification obligation will survive the termination of these Terms and your use of the Service. Weathlyzer reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with Weathlyzer's defense of such claim.

11. Governing Law and Jurisdiction

All matters relating to the Service and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of India, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the courts located in New Delhi, India, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

12. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

13. Waiver

No waiver by Weathlyzer of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Weathlyzer to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

14. Entire Agreement

These Terms of Service, together with the Privacy Policy and Cookie Policy, constitute the sole and entire agreement between you and Weathlyzer regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

15. Changes to Terms of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service. We encourage you to review these Terms periodically for any updates or changes. The "Last Updated" date at the top of this page indicates when these Terms were last revised.
